By assembling and/or using this Alchemy product, you agree that you have read and understood the entire all instructions and warnings prior to using the Alchemy product in any way. You agree to ensure any additional or subsequent user of your Alchemy product will read and understand this Release of Liability, Claim Waiver, Assumption of Risk before using any Alchemy product prior to allowing that person to use your Alchemy product.
ASSUMPTION OF RISK.
Use of the Alchemy product and any of its components involve certain risks, dangers and hazards that can result in serious personal injury and death to both the user and to non-user third parties. In using this Alchemy product, you freely agree to assume and accept any and all known and unknown risks of injury to you and third parties while using this equipment. The risks inherent in this sport can be greatly reduced by abiding by the warning guidelines listed in this owner manual and by using common sense.
Release and Waiver of Claims
In consideration of the sale of the Alchemy product to you, you hereby agree to the fullest extent permitted by law, as follows:
TO WAIVE ANY AND ALL CLAIMS
that you have or may in the future have against Alchemy Surf LLC and all related parties resulting from use of the Alchemy product and any of its components.
TO RELEASE
Alchemy Surf LLC and all related parties from any and all liability for any loss, damage, injury or expense that you or any users of your Alchemy product may suffer, or that your next of kin may suffer, as a result of the use of the Alchemy product, due to any cause whatsoever, including negligence or breach of contract on the part of Alchemy Surf LLC and all related parties in the design or manufacture of the Alchemy product and any of its components. In the event of your death or incapacity, all provisions contained herein shall be effective and binding upon your heirs, next of kin, executors, administrators, assigns, and representatives. Alchemy Surf LLC related parties have not made and expressly deny any oral or written representations other than what are set forth herein.
The Alchemy Surf Warranty
We offer our adapters manufacturing or material defects. We do not cover impact or UV damage, or corrosion related issues. Many of Alchemy's part has been iterated over many designs to the fullest extent possible to ensure brand matching tolerance issues are kept to a minimum. You must understand the Purchase of Alchemy adapters are prototypical in nature and are like custom parts that may need some modifications. You ,the user will assume risks in fitment to parts and modifications may when necessary.
WARRANTY CLAIMS
All claims must be accompanied with a clear explanation and clear dated photographs of the parts in question. We also require a dated proof of purchase in the form of an invoice or receipt.
Alchemy Surf LLC reserves the right to determine if a product will be covered under warranty once all the documentation has been received. Exchanges and Shipping We only exchange items if they are defective. If you have a Warranty claim, please first send us an email to info@alchemy.com. We will arrange for the assessment and collection of the item. Where the item is assessed and deemed to be covered under Warranty, we will cover the shipping costs. Where the item is not deemed to be covered by Warranty, you will be responsible for the return/exchange shipping cost.
